The server log files are stored by Shopify for a limited period of time and then automatically deleted. The storage of the data serves to ensure the functionality of the website, to guarantee the security of our information technology systems and to optimize our web offers.

We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible.

Note on the responsible body

The responsible party for data processing on this website is:

MoLove GmbH

12103 Berlin

Phone: 030509308270

E-mail: info@molove.com

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage duration

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for processing the data no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted after these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to the data processing, we process your personal data on the basis of Art. 6 (1) a DSGVO or Art. 9 (2) a DSGVO, if special categories of data are processed according to Art. 9 (1) DSGVO. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 (1) a DSGVO. This consent can be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 para. 1 lit. b DSGVO. Furthermore, if your data is required for the fulfillment of a legal obligation, we process it on the basis of Art. 6 para. 1 lit. c DSGVO. Furthermore, the data processing may be carried out on the basis of our legitimate interest according to Art. 6 para. 1 lit. f DSGVO. Information about the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Processing of customer and contract data

We collect, process and use personal data only to the extent that they are necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process and use personal data about the use of our website (usage data) only to the extent necessary to enable the user to use the service or to bill the user.

The collected customer data will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

We transmit personal data to third parties only if this is necessary in the context of the contract, such as to the companies entrusted with the delivery of the goods or the credit institution entrusted with the payment processing. A further transmission of data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The transfer of personal data to third parties is subject to the following conditions:

Service providers who are responsible for the operation of our website and the processing of stored or transmitted data (e.g. data centers, payment processing, IT security) receive access to your personal data. These service providers are usually order processors. The legal basis for the transfer is Art. 6 para. 1 p. 1 lit. b or lit. f DS-GVO, unless they are order processors.

Government agencies and authorities receive your personal data if this is necessary to fulfill a legal obligation. The legal basis for the transfer is then Art. 6 para. 1 p. 1 lit. c DS-GVO.

Persons involved in the performance of our business operations (e.g. auditors, banks, insurance companies, legal advisors, supervisory authorities, parties involved in company acquisitions or the establishment of joint ventures) also receive your personal data. The legal basis for the disclosure is Article 6 (1) sentence 1 lit. b or lit. f DS-GVO.

The basis for data processing is Art. 6 para. 1 lit. b DSG

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke your consent at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 DSGVO)

If the data processing is based on Art. 6 (1) e or f DSGVO, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims (objection under Article 21(1) DSGVO).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling, insofar as it is associated with such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Art. 21 (2) DSGVO).

Right of complaint to the competent supervisory authority

In the event of breaches of the GDPR, data subjects shall have a right of appeal to a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged breach. The right of appeal is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if necessary, a right to correction or deletion of this data. For this and other questions on the subject of personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. To do so, you can contact us at any time. The right to restriction of processing exists in the following cases:

If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.

If the processing of your personal data happened/is happening unlawfully, you may request the restriction of data processing instead of erasure.

If we no longer need your personal data, but you need it to exercise, defend or enforce legal claims, you have the right to request restriction of the processing of your personal data instead of deletion. If you have lodged an objection pursuant to Art. 21 (1) DSGVO, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data - apart from its storage - may only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is enabled, the data you send to us cannot be read by third parties.

Instagram

Functions of the social network Instagram are integrated on our website. These functions are provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

When the social media element is active, a direct connection is established between your end device and the Instagram server. Instagram thereby receives information about your visit to our website.

If you are logged into your Instagram account, you can link the content of our website to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to our website with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram.

Insofar as consent has been obtained, the Instagram service is used on the basis of Art. 6 (1) a DSGVO and § 25 TTDSG. The consent can be revoked at any time. Insofar as no consent has been obtained, the use of the service is based on our legitimate interest in achieving the greatest possible visibility in social media.

Insofar as personal data is collected on our website with the help of the tool described here and forwarded to Facebook or Instagram, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Art. 26 DSGVO). The joint responsibility is limited exclusively to the collection of the data and its forwarding to Facebook or Instagram. The processing by Facebook or Instagram that takes place after the forwarding is not part of the joint responsibility. Our joint obligations have been set forth in a Joint Processing Agreement. You can find the text of the agreement at https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the privacy information when using the Instagram tool and for the privacy-secure implementation of the tool on our website. Instagram is responsible for the data security of the Instagram products. You can assert data subject rights (e.g. requests for information) regarding the data processed by Instagram directly with Instagram. If you assert the data subject rights with us, we are obliged to forward them to Instagram.

For more information, please see Instagram's privacy policy at https://instagram.com/about/legal/privacy/.

Social media buttons

On our website, we use social media buttons to provide you with an easy way to share our content on various social media platforms. These buttons are provided by Shopify and allow you to share our content via Facebook, X.com (formerly known as “Twitter”), Instagram, Pinterest and other social networks.

The social media buttons are implemented as simple links to the respective platforms. If you click on one of the buttons, you will be redirected to the corresponding social media platform and the platform will receive information about your visit to our website. Please note that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by the social media platforms.

The use of the social media buttons is based on Art. 6 (1) lit. f DSGVO, as we have a legitimate interest in promoting the dissemination of our content on social media and facilitating interaction with our visitors.

To limit the processing of your data by the social media platforms, we recommend that you do not click on the social media buttons. Alternatively, you can log out of the respective platforms before visiting our website or adjust the privacy settings of your social media accounts to restrict the processing of your data.

Instafeed

We use the social media plugin Instafeed (https://apps.shopify.com/instafeed) on our website to display content from Instagram on our website. In doing so, we use the Shariff solution to ensure the privacy of our visitors. With Shariff, the social media buttons on our website are only embedded as a graphic that contains a link to the corresponding social media platform. By clicking on the graphic, you will be redirected directly to the Instagram page.

Instafeed itself only accesses certain information of the store operator, such as contact information, name, email address, phone number, location and physical address. Instafeed does not access customer data. Note, however, that we have no control over the data that Instagram collects once you click on the plugin and are redirected to Instagram. In this case, Instagram's privacy policy (https://help.instagram.com/155833707900388) applies.

If you are logged into your Instagram account and activate the Instagram plugin on our website, you can link the content of our pages to your Instagram profile. This may allow Instagram to associate the visit to our pages with your user account. We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Instagram.

The use of Instafeed and the Instagram plugin are based on Art. 6 (1) lit. f DSGVO, as we have a legitimate interest in integrating social media content on our website. This allows us to present our content in a more appealing way and to encourage interaction with our visitors.

To limit the processing of your data by Instagram, we recommend that you do not click on the content displayed by Instafeed. Alternatively, you can log out of Instagram before visiting our website or adjust the privacy settings of your Instagram account to restrict the processing of your data.

6. NEWSLETTER

Newsletter data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after unsubscribing from the newsletter or after the purpose has ceased to exist. We reserve the right to delete or block e-mail addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6 (1) lit. f DSGVO.

Data that has been stored by us for other purposes remains unaffected by this.

After you have unsubscribed from the newsletter distribution list, your e-mail address will be stored by us or the newsletter service provider in a blacklist, if necessary, to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) f DSGVO). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

7. THIRD-PARTY PLUGINS, TOOLS AND SERVICES

YouTube with enhanced privacy

This website embeds videos from the website YouTube. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended privacy mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the disclosure of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, YouTube - regardless of whether you watch a video - establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, after starting a video, YouTube may store various cookies on your end device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience, and prevent fraud attempts.

If necessary, further data processing operations may be triggered after the start of a YouTube video, over which we have no control.

YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO.

Insofar as a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) as defined by the TTDSG. The consent can be revoked at any time.

For more information about privacy at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=de.

Vimeo without tracking (Do-Not-Track)

This website uses plugins of the video portal Vimeo. The provider is Vimeo Inc, 555 West 18th Street, New York, New York 10011, USA.

When you visit one of our pages equipped with Vimeo videos, a connection to the Vimeo servers is established. This tells the Vimeo server which of our pages you have visited. In addition, Vimeo obtains your IP address. However, we have set Vimeo in such a way that Vimeo does not track your user activities and does not set any cookies.

The use of Vimeo is in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. If a corresponding consent has been requested, the processing is based exclusively on Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission and, according to Vimeo, on "legitimate business interests". Details can be found here: https://vimeo.com/privacy.

For more information on how we handle user data, please see Vimeo's privacy policy at:
https://vimeo.com/privacy.

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether the data input on this website (e.g. in a contact form) is made by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as you enter the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent by the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. You will not be notified that an analysis is taking place.

The storage and analysis of the data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) as defined by the TTDSG. The consent can be revoked at any time.
