MoLove Influencer Affiliates Program Terms & Conditions

Welcome to the MoLove Affiliate Community! As an Affiliate Influencer, you'll join us in growing the MoLove community, sharing your passion for a healthy lifestyle, and driving revenue through a mutually beneficial partnership.

We provide creators with:

• Seasonal product credit
• 10% commission on sales referred
• Access into our PRO purchase program (receive access to discount pricing on MoLove products) 
• Opportunity to participate in promotional moments 

To get you started, we provide you with retail products from our website in exchange for deliverables via Instagram which will be detailed out in the "Task Requirements" section of this proposal.

Task Requirements

Include the following in your post

• Mention in the caption: @molove

• You will receive our Influencer Guide Brief which includes
• Deliverables and Commission: Detailed information on deliverables and how to earn commission
• Best Practices: Tips for creating effective content
• Content Examples: Samples to inspire your posts
• Brand Introduction: Overview of the MoLove brand

Your Tasks

• In-Feed Instagram posts showcasing your MoLove product (2)
• Please remember to share your discount code within your caption and tag #moloveaffiliate so your content will be accounted for. Your in-feed posts can be in the form of Reels or traditional In-Feed posts.
• Four Story Slides (4)
• One story set (2 slides) within 48 hours of each in-feed post. A reminder to please remember to always share your affiliate link when you post your MoLove product (post, reel or story). Whether this be tagging the link in your story or adding the link into your bio. The reason it's so important to share this link is so we can pay you commission on the sales you convert and provide you with additional MoLove credit.

Payments

When you are onboarded, you'll receive a 20% discount code to share with your followers and community. This code is good for one use per shopper and has exclusions. You are able to use your discount code once for a personal order. Please DO NOT share this code within product reviews on our website. If you do so, the review will be removed.

Commissions

You'll be paid commission on every purchase made with your affiliate link or discount code:

10% commission on all referrals

Following a 14-day holding period, these payments will be paid out on the 1st and 15th of each month to the account connected to your profile.

Tools We Use

We use two tools to manage our influencer programs: Influencer Hero and Social Snowball. You will be assigned to one of these platforms upon acceptance into the program based on the campaign needs.

Influencer Hero

Our Instagram creators program is powered by Influencer Hero. You can track your post history and performance, access your discount code and links, track your earnings and enter your payment details in your personal Creator Hero portal.

Our affiliate creator program is powered by Social Snowball. You can track your earnings and referrals in the account portal and pay yourself out as soon as payments are released.

PLEASE READ FULLY - GIVE ATTENTION TO CONTENT USAGE RIGHTS

Influencer shall conduct the following activities comprising the Services during the Term, resulting in the following deliverables (the “Content”):

Social Media Platforms:

Instagram:

- Deliverables are stated and agreed upon under the "My Tasks" section of Social Snowball proposal 

- With each post include a minimum of two story slides (photos and/or videos) during a 48-hour timeframe, these story slides will include a sticker link with affiliate URL driving traffic to the MoLove website

- Visual Content can be both stills and/or short videos where the Brand is featured clearly.

- In-feed posts will remain live on Influencers social media for a period of 12 months after the date of original posting.

- Posts must be published within 1 month of receiving the product for testing and review.

Content Focus:

• All social media posts made by the Influencer must match MoLove's campaign and brand messages. The content should highlight how Influencers are living a healthy lifestyle and/or engaging with nature.
• The Brand has the final say on whether to accept and publish the content created by the Influencer. If the content is rejected, the Influencer must work with MoLove and the Brand to fix it quickly. If they can't agree on acceptable content, MoLove and the Brand can end the agreement. The Influencer will still be eligible for commissions on any referred sales up to that point.
• Each party keeps full ownership of its own intellectual property, like trademarks and copyrights, forever, everywhere, and in all formats. MoLove gives the Influencer permission to use certain product names, images, trademarks, and logos, but this permission is limited, can be taken back, and cannot be transferred to anyone else. The Influencer can only use these materials in the way MoLove specifies and without having to pay a fee.

Content Usage Rights:

Media creator grants MoLove a royalty-free license for all branded media developed during the duration of this partnership, giving MoLove the rights to:

• Posting to social media platforms
• Paid support of social media posts
• Use in online advertising within social media platforms
• Use in general online advertising (i.e., search, websites, email, digital, etc.)

Representations/Warranties/Indemnification:

• Influencer represents and warrants that it (a) it has the authority to enter into this Agreement and perform the Services, (b) it will perform the Services in a good, workmanlike manner and in accordance with all applicable laws, and (c) the Services and the Content will not infringe the rights of any third party.
• Influencer hereby agrees to defend, indemnify and hold harmless MoLove, Brand and their affiliates, subsidiaries, parent, officers, directors, employees, representatives, agents, successors and assigns from and against any damages, claims, losses, liabilities or expenses of any kind, including, but not limited to, reasonable attorneys' fees and disbursements, arising directly or indirectly out of any claim resulting from (i) any breach or alleged breach of this Agreement by Influencer. 

Confidentiality and Exclusivity:

• While working for the Company, the Influencer will come across confidential information and documents. The Influencer acknowledges and agrees that such information is an asset of the Company or its clients, is not generally known to the trade, is of a confidential nature and, to preserve the goodwill of the Company and its clients must be kept strictly confidential and used only in the performance of the Influencer's duties under this Agreement.

Waiver and Release: 

I (Influencer) understand that the activities I choose to partake in as part of this campaign may entail risks of injury, death to myself and other participants, and property loss or damage.

I (Influencer) AGREE TO ASSUME AND ACCEPT FULL RESPONSIBILITY for myself for bodily injury, death and loss of personal property and expenses thereof as a result of those inherent risks and dangers associated with the activities.

I (Influencer) HEREBY RELEASE any legal liability MoLove and Brand, their officers, agents, partners and employees may have for any and all injury or death or loss of or damage to property caused by or resulting from my participation in the activities.

I (Influencer) AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS MoLove and Brand, all of their officers, agents, employees and partners to the extent permitted by law for any injury or death or loss of or damage to property caused by or resulting from my participation in the activities.

THIS AGREEMENT shall be legally binding upon me, my heirs, my estate, assigns, legal guardians, and my personal representatives.

I (Influencer) HAVE CAREFULLY READ THE AGREEMENT and fully understand its Contents. I understand that MoLove and Brand are relying upon this Agreement in allowing my participation in the activities.
